1. Description of Service. Subject of the Agreement.
1.1. Welcome to the Service BigFilm hosted in the Internet at http://www.bigfilm.tv (hereinafter - Service). The service allows persons on the territory of Russia in real time through the Internet and various electronic devices to view on-line various license-length or short video content, including feature films, documentaries, popular science, educational, animated, film and television movies, music videos, etc.
1.2. Service includes video, which is available for viewing without charging users a fee and with accompanying video demonstration of advertising or without it, as well as the video available for viewing by users entirely appropriate monetary fee that is regulated in detail in Section 6 of the Agreement.
2. General
2.1. This User Agreement (hereinafter - the Agreement) establishes the rules and conditions of use of the Service users who logged in or not, implementing the use of the Service and its services, becoming a Member of the Service and the services provided by the Administrator.
2.2. User's use of the Service, any of its services, a functional means unconditional acceptance of the User with all clauses of this Agreement and unconditional acceptance of the terms and conditions to the obligations to comply with the duties imposed on the User under this Agreement. The fact of User's use of the Service, any of its services, functional, and registration of users on the Service (the creation account) is a complete and unconditional acceptance of this Agreement, the ignorance of which does not exempt the user from liability for failure to comply with its terms.
2.3. The user's consent to use the Service after any such changes shall mean its acceptance of such changes and / or additions.
2.4. The User agrees to regularly view the content of this Agreement, in order to get acquainted with its timely changes.
2.5. The Administrator reserves the right at its sole discretion, to change, and (or) supplement the Agreement at any time without prior and (or) further notice to you. The current version of the Agreement is available in the service interface at: http://bigfilm.tv.
2.6. If you (the user) do not agree to abide by this Agreement, do not use the service, and if you are a registered user, delete your account and / or stop using the Service.
3. Intellectual property
3.1. All used and placed on the Service of intellectual property, as well as the service itself is the intellectual property of their respective owners and are protected by intellectual property laws of Russia, as well as relevant international legal conventions. Any use posted on the Service of intellectual property (including elements of the visual design of the Service, symbols, text, graphics, illustrations, photos, videos, software, music, and other objects) without the permission of the Administrator of the Service or the legitimate rights holder is illegal and can serve as a the reason for the trial and bring the perpetrators to civil, administrative and criminal responsibility in accordance with the legislation of the Russian Federation.
3.2. Unless otherwise established by the Agreement, as well as the current legislation of the Russian Federation, any results of intellectual activity, posted on the Service may not be copied (reproduced), processed, distributed, displayed in a frame, published, downloaded, transferred, sold or otherwise used in whole or in part, without the prior permission of the Administrator of the Service or the legitimate right holder, unless the right holder expressly consented to the free use of the material by any person.
3.3. Access to the results of intellectual activity, posted on the Service is provided by the Administrator for your personal, non-commercial use by the user in order to examine them solely through the Service, without the right of reproduction (including copying / downloading) these results of intellectual activity in the memory of the electronic device, the user, as well as without the right to the use of these other results of intellectual activities are not specified in this Agreement, including their sale, modification, distribution in whole or part, etc.
3.4. Any use of the Service or the results of intellectual activity placed on it other than authorized in this Agreement or in the case of the express consent of the author (owner) for such use, without prior written permission is strictly prohibited.
3.5. Administrator reserves the right at any time to remove from the Service any intellectual property, placed on it without notice to User.
3.6. Access to the results of intellectual activities (video content) posted on the Service, for the user to limit the boundaries of the Russian Federation. The user guarantees that the carrying viewing video content that is hosted on the Service, located in the Russian Federation and does not / will not carry out any action aimed at circumventing technological protection measures (system of geo-blocking access to viewing video on the ip-addresses of users) restricting access to the specified video content, the boundaries of the Russian Federation.
3.7. In respect of the video posted on the Service Manager allows the user to using the media player BigFilm copy Embed-code for a particular piece of video content on the personal pages of users in different social networks (including "In Touch," Classmates »,« Facebook », «Livejournal» », etc.).
For the purposes of this Agreement, Embed-code refers to a hyperlink to a specific instance of video, allows you to display media player BigFilm with a copy of video (with the ability to view media player BigFilm) on other sites besides the Service, therefore, in which storage and communication to the public this instance is carried out directly from the video server hardware Administrator, and placing a hyperlink to third-party sites does not imply an actual instance of placing video on a site or equipment of third parties.
Administrator emphasizes that the above function of the service is intended solely for non-commercial use by the User solely for the purpose of placing Embed-code on the personal page of his Internet diary of one of the social networks of the Russian segment of the global Internet. Any use of the video or the Embed-code, unintended by this clause of the Agreement violates the terms and the exclusive rights of copyright holders and the video can cause liability stipulated by the current legislation of the Russian Federation.
4. Rights and duties of the Administrator
4.1. Responsibilities of the Administrator is solely to ensure the provision of technical ability for a user accessing the Service, within the territory of Russia, in the manner specified in this Agreement.
4.2. The Administrator reserves the right at its sole discretion to modify or remove any posted on the Services, as well as video and all elements and components of the Service, suspend, restrict or terminate a User's access to all or any of the sections of the Service at any time for any reason or without giving any reason, with or without notice thereof (at the discretion of the Administrator). The Parties agree that the administrator is not responsible for any harm that may be caused to the user such actions;
4.3. The administrator has the right to set any restrictions on the use of the Service at any time to modify this Agreement unilaterally without the consent of the User;
4.4. The administrator is entitled to exercise users mailing messages containing organizational and technical and other information on the features of the service;
4.5. The Administrator may allow users to create a single personal account (Profile). If you create more than one User account, the Administrator reserves the right to delete create a user account and / or deny user to use the Service.
4.6. The administrator has the right to set an age limit when accessing video content intended for adult audiences, posted on the Service, which means that persons under 18 years of age, undertake to refrain from access to such video content, as the Administrator may notify the User pop-up window on the Service when you try to user to view video content intended for an adult audience Service.
4.7. The administrator has the right to place advertising and / or other information in any section of the Service, interrupt the demonstration video advertising information on that user gives consent to it in this Agreement;
4.8. The Administrator shall not carry out the following actions:
4.8.1. post on the Service home addresses, phone numbers, email addresses, and other personal information (personal data) users or any third parties without obtaining their personal consent to such actions;
4.8.2. place any files that contain or may contain viruses or other malicious programs;
4.8.3. describe or promote criminal activity, place instructions or guidelines for the commission of criminal acts;
4.8.4. post on the Service any information that violates the exclusive rights of users or third parties to intellectual property;
4.9. The administrator does not deal with pre-moderation or censorship of user comments, and take action to protect the rights and interests of the individual and ensure the compliance with the legislation of the Russian Federation only after the person concerned to the Administrator in the manner prescribed by the Administrator.
